On handling of personal information Upon providing "BOYS MEETING from Thailand" ("the Service"), MEDIASEEK, Inc. (4)“Contract” means any contract between Customer and MEDIASEEK. 2.Compliance with Laws and Regulations MEDIASEEK will comply with the Applicable Privacy Legislation as MEDIASEEK obtain, handle and use in any way personal information of Customer. 3.Personal Information Collected MEDIASEEK may collect from Customer the Personal Information, including the following: (1)Name, address, date of birth, telephone number, occupation, age, and username (2)Access history data such as IP address and cookies data during (at the time of) your access to MEDIASEEK’s website (3)Shopping data, contents of inquiries, account information, orders and contract information, particulars of goods delivered, billing information, bank account information, history of transactions and contacting, as well as the information about transactions and communication between Customer and MEDIASEEK on website (4)Identification information of a terminal device 4.Purpose of Use of Personal Information 1.MEDIASEEK hereby states the purpose of use of personal information obtained from Customer. (1)Provision of intended functions of the Service (Performance of a contract) (2)Correspondence to inquiries from Customer (Performance of a contract) (3)Handling and solving problems occurred on the Service (Performance of a contract) (4)Shipping presents, gifts, commodites and other goods (Performance of a contract) (5)Revision, improvement and development of new functions of the Service (Legitimate interests) 2.MEDIASEEK will prior state the purpose of use when MEDIASEEK obtain written personal information directly from Customer. 3.In principle MEDIASEEK do not obtain sensitive Personal Data and Personal Data relating to criminal offences except in cases where it meets the requirements of the Applicable Privacy Legislation. MEDIASEEK also do not intend or wish to obtain Personal Data (directly) from minors. 4.Lack,insufficiency or inadequacy of Customer's giving Customer's personal information may cause inappropriate operation/service provision. 5.Use of Personal Information within Scope for Purposes 1.MEDIASEEK will handle personal information within the limit necessary for purposes prior stated and disclosed except for cases as set below pursuant to the Article 16 paragraph 3 of "Act on the Protection of Personal Information". (1)permitted under the relevant laws and regulations; (2)necessary to secure human live, body or property and it is difficult to obtain Customer's consent. (3)especially necessary to promote public health or healthy cultivation of children and it is difficult to obtain Customer's consent. (4)necessary to cooperate with national organ or municipal government (including any persons or entities consigned by such organ or government) in commission of such organ or government to perform its duties according to laws and regulations and in the threat that obtaining Customer's consent may interfere in such performance. 6.Method of obtaining personal information 1.MEDIASEEK obtain Customer’s Personal Data in following various ways: (1)Provided by Customer MEDIASEEK obtain information actively provided by Customer. For example, if Customer contact MEDIASEEK via the contact form, Customer provide MEDIASEEK information. When Customer provide personal data to MEDIASEEK, please do not provide information that is irrelevant, not accurate and/or unnecessary for the services provided. (2)Automatically retrieved MEDIASEEK obtain some information automatically when Customer visit MEDIASEEK’s Website. For example, MEDIASEEK automatically obtain information about Customer via cookies when Customer visit MEDIASEEK’s Website. For more information on this, please refer to “16. Cookie”. (3)Third-party sources MEDIASEEK may also obtain information from third parties in exceptional cases. (4)Derived data MEDIASEEK may perform analysis on Personal Data about Customer. The resulting data can also qualify as Personal Data about Customer. For example, MEDIASEEK may analyze which webpages are visited most frequently, and from which previous website Customer was referred to such webpage. 2.Providing certain Personal Data to MEDIASEEK may be a statutory or contractual requirement. If that is the case, MEDIASEEK will inform Customer thereof separately, and will also explain the possible consequences if Customer fail to provide such Personal Data to MEDIASEEK. 7.Warning about External Websites The website on the Internet operated by MEDIASEEK may contain an external link. In that case, please note that MEDIASEEK will not assume any responsibility for the handling of Customer’s Personal Information on the said external website. 8.Measures to Protect Personal Information MEDIASEEK will make effort to maintain Customer's personal information correct and recent and take safety control measures below to protect it against unauthorized access, falsification, leakage, loss and destruction. (1)MEDIASEEK established privacy policy as a basic policy on handling personal information. (2)For assuring appropriate handling of personal information, MEDIASEEK built Personal Information Protection Management Systems (“PMS”) regarding compliance to laws, regulations and guidelines and correspondence to inquiries and suggestions. PMS includes “Personal Information Protection Manual” which regulates plan, implementation, operation, correspondence to complaints and inquiries and correction and prevention measures and so on. (3)MEDIASEEK assigned Personal Information Protection Manager and give needed authority to such manager. (4)For protection of customer’s personal information, MEDIASEEK make needed and appropriate supervision according to PMS. In addition, MEDIASEEK give needed education and training to its employees according to PMS for assuring appropriate handling of personal information. (5)As devices, electronic media and papers on or with which personal information is handled MEDIASEEK take control on them including lock or password according to PMS. (6)Upon employees’ handling personal information, protective measures are set including limitation and control on using personal information and confinement of accessible area of personal information data-base or other media according to PMS. 9.Appropriate Handling of Personal Information in Subcontractors MEDIASEEK may subcontract the processing of Customer's personal information to certain third party within the scope necessary for the purpose. MEDIASEEK will confirm and require appropriate handling of personal information in and to such third party with taking measures including stipulation about appropriate handling of personal information in the contract between MEDIASEEK and such subcontractor. 10.Provision to Third Party 1.Without Customer's consent, MEDIASEEK will not provide Customer's personal information to a third party except for cases as set below pursuant to the Article 23 paragraph 1 of "Act on the Protection of Personal Information". (1)permitted under the relevant laws and regulations; (2)necessary to secure human live, body or property and it is difficult to obtain Customer's consent. (3)especially necessary to promote public health or healthy cultivation of children and it is difficult to obtain Customer's consent. (4)necessary to cooperate with national organ or municipal government (including any persons or entities consigned by such organ or government) in commission of such organ or government to perform its duties according to laws and regulations and in the threat that obtaining Customer's consent may interfere in such performance. 2.MEDIASEEK will share Customer’s Personal Information with MEDIASEEK’s group companies. Also, MEDIASEEK may share Customer’s Personal Information with the following business partners and/or other third parties: (1)Service providers MEDIASEEK may conduct the business by using a third party such as a shipping company and an IT service provider etc. In that case, MEDIASEEK may need to share Customer’s Personal Information for the provision of the service. The shared Personal Information about Customer will be used under the instruction of and for the purpose of MEDIASEEK. (2)Legal obligations In accordance with the Laws, MEDIASEEK may disclose Customer’s Personal Information to public authorities engaging in the enforcement of law at the requirements under the Laws, the court order, or the request of a governmental authority or law enforcement agency (including those required in terms of national security or law enforcement measures, as well as those made by a governmental authority and the court of a country where MEDIASEEK is conducting the business.) To the extent permitted by law, where necessary, MEDIASEEK may disclose Customer’s Personal Information to a third party (including a legal advisor) to prove, assert or defend against a legal claim; to exercise MEDIASEEK’s rights; to protect MEDIASEEK’s property, other ’s rights and property, or safety; or to support an external audit, MEDIASEEK’s compliance, and corporate governance function. 11.Customer’s Rights 1.The Customer have the following rights in relation to Customer’s Personal Information retained by MEDIASEEK: (1)Right to access to Customer’s own Personal Data (2)Right to request the rectification of Customer’s own inaccurate Personal Data (3)Right to request the erasure of Customer’s own Personal Data (4)Right to request the restriction on the processing of Customer’s own Personal Data (5)Right to receive Customer’s own Personal Data in a structured, commonly used and machine-readable format (6)Right to object to the processing of Customer’s own Personal Data 2.In cases where Cutomer’s Personal Data is processed on Customer’s own consent, Customer have the right to withdraw Customer’s consent in relation to Customer’s own Personal Data at any time. 3.For Customer’s submission of a request on any rights held by Customer in relation to Customer’s own Personal Information, please refer to “12. Contact for Inquiries”. 12.Contact for Inquiries 1.The contact below accepts any comment, inquiry, or complaint in relation to Customer’s own Personal Information. Rights Held by Customers”, please describe the following points and contact to “Contact for Inquiries”: (1)Contents of the Personal Information about which Customer want to make a request (2)Name of service covered (3)Reason for a request (4)Preferred method of response 3.After receiving the request from Customer, MEDIASEEK will ask such Customer to present a necessary Identification document designated by MEDIASEEK in order to confirm that the request is made by such Customer themselves. Upon completion of such confirmation, MEDIASEEK will respond to such request. If the request is made not by Customer but by a proxy, MEDIASEEK will ask such proxy to present a document evidencing the proxy's authority of representation. 13.Upon Incidence of Accident On the incidence of accidents regarding Customer's personal information, MEDIASEEK will promptly and properly deal with such accidents including immediate notice of the facts to Customer or disclosure to the public. 14.Handling of Personal Data of Customers below 16 Years Please understand that if Customer is below the age of 16 years, MEDIASEEK will ask the consent of such Customer’s parental guardian, where necessary, before receiving the provision of Customer’s Personal Data. 15.Retention Period MEDIASEEK will not retain Personal Information beyond the purposes for which it was obtained and any other reasonable purposes incidental or related to such purposes or as required by Applicable Privacy Legislation. 16.Cookie 1.On MEDIASEEK’s website, MEDIASEEK may use cookies or another automatic information collection program, where necessary, subject to Customer’s consent. Cookies are the function to store the information about Customer on the Customer’s browser or hard drive through MEDIASEEK’s website. By using cookies, Customer can save time to re-type the information already stored on Customer’s hard drive. Cookies also be helpful to improve the usability of the website by recording how and when the website is used. Customer may choose to disable cookies through Customer’s browser settings, but this may cause certain features of MEDIASEEK’s website do not work. 2.The service uses Google Analytics to obtain information about site usage. For more information on how Google Analytics collects and handles information, please refer to the following website. https://www.google.com/policies/privacy/partners/ 17.Other Terms 1.Please note that if Customer do not provide MEDIASEEK with current and accurate information about such Customer themselves, Customer may not be able to receive proper service. 2.Customer have the right to lodge an objection to the processing of the Personal Information in relation to Customer with the data protection supervisory authority having jurisdiction over the place of Customer’s residence. 18.Change or update Privacy Policy MEDIASEEK may change or update this Privacy Policy at any time without limiting the rights of individuals as described in this Privacy Policy. If MEDIASEEK change or update this Privacy Policy, MEDIASEEK will state the date of the update. 19.Continuous Improvement According to personal information protection and management system, MEDIASEEK will continuously endeavor to improve the handling of personal information through maintenance of internal rules, education to employees and internal audit.
